- ENGLISH: OFFER AND ACCEPTANCE - Offer and acceptance analysis is a traditional approach in contract law used to determine whether an agreement exists between two parties. Agreement consists of an offer by an indication of one person (the "offeror") to another (the "offeree") of the offeror's willingness to enter into a contract on certain terms without further negotiations. A contract is said to come into existence when acceptance of an offer (agreement to the terms in it) has been communicated to the offeror by the offeree and there has been consideration bargained-for induced by promises or a promise and performance.
The offer and acceptance formula, developed in the 19th century, identifies a moment of formation when the parties are of one mind. This classical approach to contract formation has been weakened by developments in the law of estoppel, misleading conduct, misrepresentation and unjust enrichment.

- FRENCH (FRANÇAIS) - POLLICITATION ET ACCEPTATION: Le terme de pollicitation tient son origine dans le droit romain, où celui-ci correspondait à une promesse de don réalisée par un candidat à une magistrature municipale. De nos jours, en droit civil français, la pollicitation ou offre est le fait de proposer la conclusion d'un contrat.
Dans un sens large, presque courant, l'offre de contrat peut simplement être une proposition de contracter, c'est-à-dire une proposition de réaliser un contrat. Cependant, le droit fait une distinction entre les deux expressions, la proposition de contracter n'étant pas soumise au même régime juridique. Une offre n'est véritablement une pollicitation que si une réponse affirmative, pure et simple (l'acceptation), suffit à créer un contrat entre les deux parties. Dans d'autres hypothèses, on disqualifiera cette offre en proposition d'entrer en pourparlersN 3 ou en appel d'offresN.
En droit civil français, l'acceptation est le consentement d'une personne (appelée acceptant) à une offre de contrat qui lui a été faite. C'est un acte unilatéral de volonté, émanant du destinataire d'une pollicitation, qui montre l'intention de celui-ci de conclure le contrat.
En vertu du principe de liberté contractuelle, celui qui accepte doit toujours être libre de conclure ou de ne pas conclure le contrat : il ne pourra donc pas être contraint à accepter l'offre.

El ejemplo clásico es el del comercio minorista que ofrece sus productos a cualquiera, a un precio determinado. La oferta es obligatoria, es decir, una vez emitida, el proponente no puede modificarla en el momento de la aceptación del sujeto interesado. La aceptación de la oferta debe ser explícita, de modo que el otro contratante debe mostrar su consentimiento expreso o tácito, de manera que indique su inequívoca intención de aceptar la oferta y adherirse a las condiciones del oferente. La vigencia obligatoria de la oferta varía en los distintos ordenamientos jurídicos. Para algunos, el oferente puede variar la oferta mientras ésta no haya sido aceptada; en cambio en otros la oferta debe mantenerse intacta por todo el período que, usual o legalmente, se reconozca al contratante para aceptarla.
