JOINT CUSTODY:
- ENGLISH: JOINT CUSTODY is a court order whereby custody of a child is awarded to both parties. In joint custody both parents are "custodial parents" and neither parent is a non-custodial parent; or, in other words, the child has two custodial parents.
Many states recognize two forms of joint custody: joint physical custody, and joint legal custody. In joint legal custody, both parents share the ability to have access to educational, health, and other records, and have equal decision-making status where the welfare of the child is concerned.
In joint physical custody, which is also known as joint physical care, actual lodging and care of the child is shared according to a court-ordered custody schedule (also known as a "parenting plan" or "parenting schedule"). In many cases, the term 'visitation' is no longer used in these circumstances, but rather is reserved to sole custody orders. In some states joint physical custody creates a presumption of equal shared parenting, however in most states, joint physical custody creates an obligation to provide each of the parents with "significant periods" of physical custody so as to assure the child of "frequent and continuing contact" with both parents. Courts have not clearly defined what "significant periods" and "frequent and continuous contact" mean, which requires parents to litigate to find out.

La résidence alternée est une organisation de l'hébergement de l'enfant mineur dont les parents ne vivent pas dans le même domicile, par exemple dans le cas d'un divorce. Un enfant en résidence alternée vivra en alternance au domicile d'un parent puis de l'autre. Le droit de la Résidence alternée s'inspire autant de principes universels (égalité, équité, équilibre) que des droits nationaux. On peut noter que la définition est assez générale, et ne définit pas la fréquence d'alternance de ce mode de résidence. La définition de l'alternance du Dictionnaire Lexilogos du CNRS se réfère à l'alternance des jours et des nuits, ainsi qu'à la notion de régularité. Cette régularité est fixée soit par accord entre les parents, soit par l'autorité juridique. Le bien-être de l'enfant est la référence centrale de toute alternance, naturelle, ou biologique, ou résidentielle.

- SPANISH (ESPAÑOL) - CUSTODIA COMPARTIDA: La custodia compartida es la situación legal mediante la cual, en caso de separación matrimonial o divorcio, ambos progenitores ejercen la custodia legal de sus hijos menores de edad, en igualdad de condiciones y de derechos sobre los mismos. No se debe confundir la custodia legal con la patria potestad. En el caso de custodia no compartida, y salvo casos excepcionales, los progenitores siguen teniendo los dos la patria potestad sobre los hijos. Este tipo de custodia la establece, en su caso, el juez, en la sentencia que dicte las medidas aplicables a la separación o divorcio.
Se contrapone a la figura de la custodia monoparental, que es la usual en países de raigambre latina. En caso de divorcio, cualquiera fuera la causa del mismo, suele darse la custodia a uno de los padres, confiriéndose al otro el derecho de visitas y el pago de los alimentos. En algunos casos esta solución del conflicto posconyugal resulta satisfactoria para las tres partes involucradas: hijos, madre y padre. Pero hay muchos otros casos en que fracasa, generando problemas tales como la falta del pago de los alimentos, el alejamiento del padre visitante, un síndrome de alienación parental del que termina criando solo a sus hijos y el dolor de los menores por no contar con uno de sus progenitores.
